Terms of Use

These Terms of Use ("Terms") govern your access to and use of novemburger.org (the "Site") and any related services, including the annual NOVEMBURGER™ event operated by NOVEMBURGER INC. ("NOVEMBURGER", "we", "us", or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Trademarks

NOVEMBURGER™ and the NOVEMBURGER™ logos are trademarks of NOVEMBURGER INC. "Novemburger" and "Novemburgers" refer to the limited-edition burgers created by participating restaurants during the event. You may not use our trademarks without prior written permission, except for factual reference to the event.

Using the Site

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of the Site. You may not attempt to gain unauthorized access to any part of the Site, interfere with its operation, or manipulate voting or enrollment submissions.

Restaurant enrollment

Information submitted through the restaurant enrollment form is reviewed by NOVEMBURGER INC. Submission does not guarantee participation. Participating restaurants agree to follow the event guidelines communicated separately, including menu, pricing, and reporting requirements.

Voting rules

• The Fan Favourite vote runs during the November event window.
• One vote per person. We use device / browser fingerprinting and hashed IP checks to enforce this. Attempts to submit multiple votes may be disqualified at our sole discretion.
• Only restaurants officially listed as participants for the current season are eligible to receive votes.
• The restaurant that receives the most valid online votes at the end of the voting window wins the Fan Favourite title and receives a commemorative plaque.
• Separately, the restaurant that sells the most Novemburgers during the month, as reported to and verified by NOVEMBURGER INC., is recognized on the official NOVEMBURGER™ trophy.
• NOVEMBURGER INC. is the sole judge of eligibility and results and may adjust or void results in the event of fraud, error, or technical failure.

Third-party content and links

The Site references participating restaurants, ambassadors, media outlets, and other third parties, and may link to their websites and social profiles. Menus, pricing, hours, availability, and other restaurant information are provided by the restaurants themselves and can change without notice. NOVEMBURGER INC. is not responsible for the accuracy of third-party information, for the food or service provided by any restaurant, or for the content of any third-party site.

Intellectual property

All content on the Site, including text, graphics, logos, and images, is owned by NOVEMBURGER INC. or its licensors and is protected by applicable intellectual property laws. You may view and share Site content for personal, non-commercial purposes only.

Disclaimer

The Site and the event are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law, NOVEMBURGER INC. disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, NOVEMBURGER INC. and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, participation in the event, or any food, service, or content provided by participating restaurants or third parties.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located in Ontario for any dispute arising out of or relating to these Terms or the Site.

Changes

We may update these Terms from time to time. Changes take effect when posted on this page. Your continued use of the Site after changes are posted means you accept the updated Terms.
